Rent Agreement Stamp Paper Value and Registration by State
It depends on your State. Stamp duty is set by each State's stamp law and is usually calculated on the rent and sometimes the deposit. Registration is compulsory for leases over one year under Section 17, Registration Act, 1908, and always in Maharashtra.
Ask a broker what stamp paper a rent agreement needs and you will often hear "₹100 is enough" or "just get it notarised". Sometimes that is right. Often it is not. The value of stamp paper is not a fixed fee. It is the stamp duty payable on that particular agreement, worked out under the stamp law of the State where the property is, and it changes with the rent, the term and, in some States, the deposit. Registration is a separate step with its own rules. This guide explains how the duty is calculated, which agreements must be registered, what happens if you get it wrong, and where to check the current rates for your State. We deliberately do not list rupee figures by State: rates are revised often, and the official calculator is the only safe source.
Key takeaways
- Stamp paper value means the stamp duty payable on your agreement, not a standard denomination like ₹100 or ₹500.
- Duty is set by State law and is usually a percentage of the rent for the term, sometimes with part of the deposit added.
- Leases from year to year, longer than one year or reserving a yearly rent must be registered under Section 17 of the Registration Act, 1908.
- In Maharashtra, every leave and licence agreement must be registered regardless of term, under Section 55 of the Maharashtra Rent Control Act, 1999.
- An understamped agreement can be impounded and is not admissible as evidence until the shortfall and penalty are paid.
What does rent agreement stamp paper value actually mean?
Every instrument chargeable with duty must be stamped before or at the time it is signed. For a rent agreement, the "stamp paper value" is simply the amount of stamp duty that the law charges on that document. You can pay it by buying non-judicial stamp paper of that value, by e-stamping, or by franking, depending on what your State allows.
The common mistake is to treat stamp paper as a formality, like a letterhead. People buy a ₹100 or ₹500 paper because that is what the vendor keeps in stock, then print a 22-month lease with a large deposit on it. If the duty actually payable is higher, the document is understamped, even though it looks official.
The rent agreement stamp paper price you pay at the counter should therefore come from a calculation, not from habit.
Who sets stamp duty on rent agreements?
Stamp duty on most documents, including leases, is a State subject. Some States apply the Indian Stamp Act, 1899 with their own amendments and rate schedules. Others have their own stamp Acts. Maharashtra has the Maharashtra Stamp Act, Karnataka the Karnataka Stamp Act, 1957, Gujarat the Gujarat Stamp Act, 1958 and Kerala the Kerala Stamp Act, 1959. Tamil Nadu, Uttar Pradesh and West Bengal apply the Indian Stamp Act, 1899 as amended in its application to those States.
This means two identical agreements, one for a flat in Gurugram and one for a flat in Pune, can carry different duty. Delhi and Haryana are close neighbours but are separate stamp jurisdictions with their own schedules and portals.
How is stamp duty on a rent agreement calculated?
The exact formula varies, but most States use some combination of the following factors.
Many States charge a percentage of the average annual rent, or of the total rent for the period, with different rates for different lease lengths. Some States add a notional amount for a refundable security deposit, and almost all add any premium, fine or advance that is not refundable. A few States have low or fixed duty for short residential agreements. Maintenance and society charges may or may not be counted, depending on how the agreement describes them.
Because so many variables are involved, the safest approach is to use the official calculator on your State's stamps and registration website, or ask the e-stamp vendor to compute it from the actual rent, term and deposit in your draft.
- Term: how many months the agreement runs, including any agreed renewal.
- Rent: the monthly rent and any agreed escalation during the term.
- Deposit: whether the refundable deposit is counted, and how.
- Premium or non-refundable amounts: usually added to the base for duty.
- Type of property: residential and commercial premises can carry different rates.
Is rent agreement registration compulsory?
Under Section 17 of the Registration Act, 1908, a lease of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent must be registered. Section 107 of the Transfer of Property Act, 1882 says the same type of lease can only be made by a registered instrument. This is the main reason agreements are drafted for 11 months in most States: they fall below the one-year line.
Registration of a shorter agreement is not compulsory under the central law, but Section 18 of the Registration Act allows you to register it voluntarily. Some tenants do this when the deposit is large or they need strong address proof.
There are important exceptions. In Maharashtra, Section 55 of the Maharashtra Rent Control Act, 1999 requires every leave and licence or letting agreement to be in writing and registered, whatever its length, and puts the responsibility on the landlord. Tamil Nadu and Uttar Pradesh have newer tenancy laws that require tenancy agreements to be reported to a Rent Authority. Where a State has adopted a law based on the Model Tenancy Act, 2021, check what it requires, because the Model Act by itself has no force.
State-by-State: where the rules differ
| State | Stamp law | Must an 11-month agreement be registered? |
|---|---|---|
| Maharashtra | Maharashtra Stamp Act | Yes. Section 55, Maharashtra Rent Control Act, 1999 requires registration of all leave and licence agreements |
| Karnataka | Karnataka Stamp Act, 1957 | Not compulsory under the Registration Act if under one year; check any State rent law filing rule |
| Delhi | Indian Stamp Act, 1899 as applied in Delhi | Not compulsory under the Registration Act if under one year; check any State rent law filing rule |
| Haryana | Indian Stamp Act, 1899 as applied in Haryana | Not compulsory under the Registration Act if under one year; check any State rent law filing rule |
| Tamil Nadu | Indian Stamp Act, 1899 as amended for Tamil Nadu | Tenancy agreements must be reported to the Rent Authority under the State's 2017 tenancy law |
| Uttar Pradesh | Indian Stamp Act, 1899 as amended for Uttar Pradesh | Tenancy agreements must be intimated to the Rent Authority under the State's 2021 tenancy law |
What about rent agreement registration charges in Delhi and Haryana?
When you register an agreement, you pay two things: the stamp duty on the document, and a registration fee to the Sub-Registrar, plus small scanning or processing charges. The fee schedule is notified by each State and is revised from time to time, so check the current figure on the Delhi revenue department site or the Haryana revenue and registration portal before you book an appointment.
For agreements under one year in Delhi and Haryana, registration is generally optional, so many people only stamp and sign. If you choose to register, both parties, or their authorised representatives, usually need to appear with identity proof and two witnesses, unless the State allows an online or remote process.
What happens if the agreement is understamped or unregistered?
An understamped agreement is still a contract between the parties, but it is weak in court. Under Section 33 of the Indian Stamp Act, 1899, an authority before whom it is produced can impound it. Under Section 35, it is not admissible in evidence until the deficit and a penalty are paid; the penalty can be up to ten times the shortfall. States with their own Acts have equivalent provisions, sometimes under a different section number, such as Section 34 of the Maharashtra Stamp Act.
An agreement that needed registration but was not registered faces a separate problem. Section 49 of the Registration Act, 1908 says it cannot affect the property or be received as evidence of a transaction affecting it, although it may still be used for limited collateral purposes. In Maharashtra, an unregistered leave and licence also exposes the landlord to a penalty under the Rent Control Act.
In practice, these problems surface when there is a dispute over the deposit, eviction or unpaid rent. That is the worst time to discover that your key document cannot be used without paying a penalty first.
E-stamp, franking or physical stamp paper?
Most States now prefer e-stamping, where you pay the duty online or through an authorised centre and receive a certificate with a unique number. Many States use Stock Holding Corporation of India Ltd (SHCIL) as the central record keeping agency; some run their own portals. Franking at authorised banks and physical non-judicial stamp paper are still accepted in some places.
The method does not change the duty. What matters is that the amount is correct, the certificate names the right parties and describes the transaction, and the stamp is dated on or before the date you sign. An e-stamp certificate can be checked online, which makes it harder to pass off a fake, so verify it before anyone signs.
Who pays the stamp duty: landlord or tenant?
The agreement can decide this. If it is silent, Section 29 of the Indian Stamp Act, 1899 generally places the duty on a lease on the lessee, and the State Acts usually follow a similar rule. In most cities the tenant pays the stamp duty and registration charges by custom, but this is negotiable, and splitting the cost equally is common for longer leases.
Whoever pays, make sure the e-stamp certificate names the correct parties and property, and keep the original or a verified copy with your records.
A practical checklist before you print
- Finalise rent, term, escalation and deposit before calculating duty.
- Use the official State calculator or ask the e-stamp vendor to compute duty on those figures.
- Buy e-stamp paper in the name of one of the parties, and verify the certificate online.
- Check whether your State requires registration even for 11 months, as Maharashtra does.
- If registration is optional, decide whether the deposit size justifies registering anyway.
- Keep a soft copy and the stamp certificate number with your rent receipts.

Common questions
Is ₹100 stamp paper enough for a rent agreement?
Sometimes, but not always. The right value is the stamp duty your State charges on that specific agreement, which depends on the rent, the term and sometimes the deposit. Using a fixed ₹100 paper when more is payable makes the agreement understamped, which can make it inadmissible as evidence until the shortfall and a penalty are paid.
What is the rent agreement stamp paper price in my State?
Rates are set by each State and revised from time to time, so the reliable source is your State's stamps and registration website or its online stamp duty calculator. Enter the actual rent, term and deposit from your draft. E-stamp vendors can also calculate it, but cross-check their figure against the official calculator before paying.
Is rent agreement registration compulsory for 11 months?
In most States, no. Section 17 of the Registration Act, 1908 only makes registration compulsory for leases from year to year, over one year, or reserving a yearly rent. Maharashtra is the main exception: all leave and licence agreements must be registered. Tamil Nadu and Uttar Pradesh require tenancy agreements to be reported to a Rent Authority.
What are rent agreement registration charges in Delhi or Haryana?
You pay stamp duty on the agreement and a registration fee to the Sub-Registrar, plus small processing charges. The fee schedule is notified by each State and changes, so check the current rate on the official revenue or registration portal. For agreements under one year, registration in Delhi and Haryana is generally optional.
Can an unregistered rent agreement be used in court?
An unregistered agreement for 11 months or less, if properly stamped, can usually be used as evidence of the terms. An agreement that legally required registration but was not registered cannot affect the property under Section 49 of the Registration Act, 1908, though it may be used for limited collateral purposes. Understamping is a separate issue.
Can I pay the stamp duty later if I signed on plain paper?
Yes, but at a cost. An unstamped or understamped document can be impounded and validated by paying the deficit plus a penalty, which under Section 35 of the Indian Stamp Act, 1899 can be up to ten times the shortfall. It is cheaper and simpler to stamp the agreement correctly before or at the time of signing.
